King Canute for County Judge!

So there’s this woman who says she is a really man but a DNA mistake imprisoned her in a female body.  After some period of years, she goes to court and gets a judge to reassign her identity before any surgery was performed.  So she’s got a court order, and on the strength of a court order, she’s now got a revised birth certificate, driver’s license, and whatever else you use in society to establish identity.  Some time after all that, she went ahead with surgery to become a he, although the extent of the surgery is not specified in public records that I could find.

Later on, he/she gets a job which only men can have.  The job, if you must know, is witnessing collection of urine specimens for drug testing.  For those who are not familiar with the legalities of drug testing programs, there are situations in which it is required that a witness visually verify that the fluid passes from the subject’s body untouched and into a cup.  Not a nice job, but somebody’s got to do it.  That was the job.

The boss eventually discovers that this “man” is a woman, challenges him/her on the surgical history, then fires him/her.  Now there’s a lawsuit over it.  Commentary from one nationally known lawyer says that if she’s got a court order saying she’s a he, “I don’t know how you get around that.”

So here’s the situation.  We have  what the philosophers call a brute fact: This person is verifiably, genetically female.  Over against that, one judge issued a decree in bald contradiction of that the brute fact.

Which one will we all be ordered to respect?  Well, that’s precisely the matter under dispute.  It’s six ways astonishing that we’ve come to the point where a judge can issue a ruling that flat-out contradicts a brute fact.  The judge would be equally justified saying this woman has six legs because she claims to have always felt like a hexapod inside.  How this can happen without his being laughed out of the solar system is the first great imponderable in this bedraggled little saga of Americanized jurisprudence.

The second great imponderable is how an employer could be brought before the bar of justice for firing a person who omitted important facts on a job application in which gender is a crucial aspect of the job.  In his case, the reality actually mattered more than the legal fiction.  Can an employer actually be sued for knowing the truth in the face of an idiotic ruling from a judge?

There’s an old King James word for the mental state of a person who is so blinded by sin that he can no longer distinguish right from wrong.  The word is reprobate.  American civilization has in large measure become reprobate, stricken with an inability to distinguish true from false.  And once that happens, it’s not just that a creeping anarchy advances like kudzu smothering everything.  What really happens is the morality becomes inverted with good being punished as evil and evil being rewarded as good.

Christian apologists often argue that, apart from God, it’s impossible to truly know anything.  If you needed any practical confirmation, here it is.

    so well written…I’m sorry…I know it’s a pathetic reality, but this made me laugh so loud I’ve got tears in my eyes.
